Thu 5/8/2008 Brian White, a DEQ spokesman in Portland said that the breach filed against the Michigan Company, was discovered during a compliance inspection of the project in September. The company has the license issued by DEQ for performing asbestos abatement jobs. White said that the company is appealing against the ruling. As per the allegations of DEQ, PAS has committed willful violations against federal asbestos safety regulations by allowing the accumulation of asbestos debris; by failing to effectively wet ceiling tiles containing asbestos; and by not keeping asbestos-containing vinyl flooring sufficiently wet until appropriate disposal. Willful violations are charged against an employer when they consciously violate employee safety regulations. Danny Bennett, the company's founder and president, was not available to comment on the issue.
The Oregon Department of Environmental Quality has charged a Michigan asbestos abatement company more than $24,000 for violating state and federal asbestos safety regulations. The state alleges that Melvindale based Performance Abatement Services (PAS) violated safety rules during an asbestos abatement project last year at Candalaria Mall in South Salem.
