Woman files asbestos lawsuit against 26 companies

A woman is suing 26 defendant companies in an asbestos case, claiming that her husband died of a wrongfully caused disease.

According to the lawsuit filed Sept. 4 in Jefferson County District Court, Bonnie’s husband Weldon F. Duncan worked as an insulator and electrician helper, and he was exposed to asbestos and asbestos-containing products during his job.

Bonnie argues that the defendants failed to warn Duncan regarding the hazards of asbestos exposure.

The suit states that the defendants failed to provide Duncan with a safe workplace, allowed a dangerous condition to exist on their premises, failed to warn Duncan that asbestos could cause terminal diseases and failed to provide protective clothing garments to wear in the dangerous environment.

Bonnie claims that the defendant companies also failed to provide sufficient insulation, failed to use substitute products that were safer than asbestos products, allowed the installation as well as removal of asbestos, failed to put warning labels on asbestos containers, failed to warn Duncan regarding the proper handling of asbestos and failed to adopt an appropriate safety plan.

A.W. Chesterton, Atlantic Richfield, Anco Insulation, Babcock Borsig Power, Beazer East, CBS, Chevron, Cleaver Brooks, Crane Co., Crown, Cork and Seal, General Electric, Goodrich, Gulf Oil, Ingersoll Rand, Lockheed Martin, Sepco Corp., Texaco, Union Oil Company of California, and Uniroyal Holdings and Unocal Corp. are some of the defendants named in the lawsuit.

Bonnie says that Duncan was not aware of the consequences of asbestos exposure. According to the lawsuit, Duncan suffered physical pain, mental anguish, disfigurement and physical impairment as a result of his asbestos exposu

Bonnie argues that Duncan also suffered mental anguish and incurred medical cost and funeral and burial expenses. She is seeking unspecified actual and exemplary damages, in addition to costs, pre- and post-judgment interest and for other relief to which she may be entitled.

The case will be presided over by Judge Milton Shuffield of 136th District Court.
